Welcome to Appmosphere Limited. These Terms and Conditions (“Terms”) govern your access to and use of the Appmosphere Limited mobile application, website, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.

 

1. Eligibility

You must meet the minimum age required to use the Services in your country or jurisdiction.

If you are under the applicable age of majority, you may use the Services only with the permission and supervision of a parent or legal guardian where required by law.

You represent that the information you provide to us is accurate and that you have the legal capacity to agree to these Terms.

 

2. Creating an Account

Certain features may require you to create an account.

You agree to:

• Keep your login credentials secure.
• Not share your account with unauthorized persons.
• Notify us if you believe your account has been compromised.
• Be responsible for activity occurring through your account, subject to applicable law.

You retain ownership of your User Content, subject to the rights you grant us under these Terms.

• Distribute malware, viruses, or harmful software.
• Circumvent security or access controls.

• Spam users or send unsolicited commercial communications where prohibited.
• Exploit minors or engage in sexual or otherwise abusive conduct involving minors.
• Use the Services in a manner that could reasonably harm the App, its users, or our systems.
  

We may remove content or take other enforcement action when we reasonably believe that content or conduct violates these Terms, our policies, or applicable law.

 

5. Content Moderation

We may review, moderate, restrict, remove, or disable access to User Content.

We may also restrict or suspend accounts when necessary to protect users, comply with law, prevent fraud or abuse, or enforce our policies.

Where required by applicable law, we will provide appropriate notice, explanation, appeal, or other procedural protections.

 

6. Intellectual Property

The Services, including the App's software, design, graphics, trademarks, logos, features, and other materials provided by us, are owned by or licensed to Appmosphere Limited and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from our Services.

8. Paid Services and Subscriptions

Some features may require payment.

Prices, billing periods, renewal terms, and applicable taxes will be presented before purchase.

Unless otherwise stated, subscriptions may automatically renew until cancelled.

Your use of paid services is also subject to our Refund Policy.

 

9. Third-Party Services

The Services may contain links to or integrate with third-party websites, applications, payment providers, advertising services, or other platforms.

We are not responsible for third-party services, their content, availability, security, or policies. Your use of third-party services may be subject to separate terms and privacy policies.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, store, and disclose personal information.

 

11. Account Suspension and Termination

You may stop using the Services at any time.

We may suspend, restrict, or terminate your account if:

We do not guarantee that:

• The Services will always be available or uninterrupted.
• The Services will be error-free.
• User-generated content will be accurate, reliable, or appropriate.
• The Services will be free from security vulnerabilities.
  

Nothing in these Terms excludes or limits any consumer rights or other rights that cannot legally be excluded or limited.

 

13. Limitation of Liability

To the maximum extent permitted by applicable law, Appmosphere Limited will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.

Our total liability for claims arising out of or relating to the Services will be limited to the amount you paid to us for the Services during the six months preceding the event giving rise to the claim, unless applicable law requires otherwise.

 

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Appmosphere Limited and its officers, directors, employees, contractors, and affiliates from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, your User Content, or your unlawful use of the Services.

 

15. Dispute Resolution

Any dispute arising from these Terms or the Services will be governed by the laws of the user’s State/Country, without regard to its conflict-of-law principles.

Any applicable dispute-resolution, arbitration, class-action, or venue provisions should be reviewed and customized by qualified legal counsel based on where your users are located.

 

16. Changes to These Terms

We may modify these Terms from time to time.

When we make material changes, we may provide notice through the App, website, email, or other reasonable means.

Your continued use of the Services after the updated Terms become effective means that you accept the revised Terms, to the extent permitted by law.
